NOTICE OF PRIVACY PRACTICES & CONFIDENTIALITY

Broadway Counseling Services of Denver

This Notice describes how your health information may be used and disclosed and how you can access that information. Please review it carefully.

Broadway Counseling Services of Denver (“we,” “us,” or “our”) provides substance use disorder treatment and DUI education services regulated by the Colorado Behavioral Health Administration (BHA).

Because we provide substance use disorder services, your information is protected by:

  • The Health Insurance Portability and Accountability Act (HIPAA)
  • 42 CFR Part 2 (Federal Substance Use Disorder Confidentiality Law)
  • Colorado state law

These laws provide strong privacy protections for your records.

 


 

1. Protected Health Information (PHI)

Your Protected Health Information (PHI) includes:

  • Your identity as a client
  • DUI education or treatment participation
  • Assessment results
  • Attendance records
  • Progress notes
  • Payment records
  • Communications related to your treatment

Under 42 CFR Part 2, the fact that you are receiving substance use disorder services is itself confidential.

 


 

2. How We May Use and Disclose Your Information

We may use or disclose your information without your written authorization only in limited circumstances:

A. Treatment

To provide and coordinate your care.

B. Payment

To obtain payment from you or your insurance provider.

C. Health Care Operations

For internal administrative functions such as supervision, licensing, auditing, and quality assurance.

D. Reporting as Required by Law

We may disclose information when legally required, including:

  • Court orders that comply with 42 CFR Part 2
  • Mandatory reporting of child abuse or neglect
  • Mandatory reporting of abuse of at-risk adults
  • Imminent threats to health or safety

E. Court, Probation, or Referral Reporting

If you are court-ordered or referred by probation, disclosures to the referring authority will only occur:

  • As permitted by law, and
  • Pursuant to a valid written authorization signed by you, or
  • Under a proper court order meeting 42 CFR Part 2 standards

We do not release DUI treatment information without proper legal authority.

 


 

3. Uses and Disclosures Requiring Your Written Authorization

Under 42 CFR Part 2:

We will not disclose your substance use disorder treatment information unless:

  • You sign a valid written Release of Information (ROI), or
  • A specific Part 2 court order is issued

This includes disclosures to:

  • Family members
  • Employers
  • Attorneys
  • Courts (unless legally authorized)
  • Probation officers (unless authorized or legally compelled)

You may revoke your authorization at any time in writing.

 


 

4. Telehealth & Zoom Services

Broadway Counseling may provide services via secure telehealth platforms, including Zoom for Healthcare.

By participating in telehealth services, you acknowledge:

  • Electronic communications carry inherent privacy risks
  • Technology failures may occur
  • Absolute confidentiality cannot be guaranteed in virtual settings

We use reasonable safeguards to protect your information, including:

  • HIPAA-compliant telehealth platforms
  • Encrypted communication where applicable
  • Business Associate Agreements (BAAs) with technology vendors

Clients are responsible for participating in telehealth sessions from a private location.

 


 

5. Group Treatment & DUI Education Confidentiality

Many DUI education and therapy services are provided in group settings.

While Broadway Counseling requires all group participants to maintain confidentiality:

  • We cannot guarantee that other participants will maintain confidentiality.
  • Group members are legally and ethically expected to protect the privacy of others.

Participation in group services acknowledges this limitation.

 


 

6. Your Rights

You have the right to:

• Access Your Records

Request access to your treatment records (with limited exceptions).

• Request Amendment

Request correction of inaccurate or incomplete information.

• Request Restrictions

Request limits on certain disclosures (not all requests must be granted).

• Confidential Communications

Request alternative communication methods.

• Accounting of Disclosures

Request a list of certain disclosures made without your authorization.

• File a Complaint

File a complaint without retaliation.

 


 

7. Data Security

We implement administrative, technical, and physical safeguards to protect your records.

However, no electronic system is 100% secure. By engaging in telehealth services, you acknowledge these risks.

 


 

8. Records Retention

Client records are maintained in accordance with:

  • Colorado state law
  • BHA requirements
  • Federal confidentiality laws

Records are retained for the legally required period before secure destruction.

 


 

9. Complaints

If you believe your privacy rights have been violated, you may file a complaint with:

10. Changes to This Notice

We reserve the right to modify this Notice. Updated versions will apply to all records we maintain and will be made available upon request.
