Telehealth / Zoom Services Disclaimer

Broadway Counseling Services of Denver (“we,” “us,” or “our”) provides telehealth services, including mental health counseling, DUI education, and substance use disorder treatment, using secure video conferencing platforms such as Zoom for Healthcare.

By using telehealth services, you acknowledge and agree to the following terms:

 


 

1. No Therapist-Client Relationship via Telehealth

Use of the Website or telehealth platform does not create a therapist-client relationship. A formal relationship is established only after:

  • Completion of required intake forms
  • Signed agreements (including Telehealth Consent and HIPAA / 42 CFR Part 2 acknowledgments)
  • Acceptance by a licensed provider

 


 

2. Risks of Telehealth Services

Telehealth sessions involve the transmission of your personal and clinical information over electronic systems. While we use reasonable security measures, you acknowledge that:

  • Electronic communications carry inherent privacy risks
  • Technology failures or interruptions may occur
  • Absolute confidentiality cannot be guaranteed

 


 

3. Privacy and Security Measures

We use:

  • HIPAA-compliant telehealth platforms
  • Encryption where applicable
  • Business Associate Agreements (BAAs) with technology vendors

 

You are responsible for participating in sessions from a private and secure location and for preventing unauthorized access to your session.

 


 

4. Protected Health Information (PHI)

Telehealth services are subject to:

  • HIPAA (Health Insurance Portability and Accountability Act)
  • 42 CFR Part 2 (Substance Use Disorder Confidentiality)
  • Colorado state confidentiality laws

 

Your clinical information is treated as Protected Health Information (PHI) once you establish a therapist-client relationship. Telehealth communications do not automatically create PHI until services are formally initiated.

 


 

5. Emergency Situations

Telehealth services are not appropriate for emergencies.

If you are experiencing a mental health or substance use crisis, you must:

  • Call 911 immediately
  • Contact your local emergency room
  • Call the Suicide & Crisis Lifeline at 988 (U.S.)

 

Do not rely on telehealth sessions for urgent or emergency care.

 


 

6. Limitations of Telehealth Services

By participating in telehealth sessions, you acknowledge:

  • Group confidentiality may be limited in virtual sessions
  • We cannot control the environment of other participants in group sessions
  • Session recordings, screenshots, or unauthorized sharing by participants are prohibited

 

Violations of confidentiality by participants may occur despite our policies.

 


 

7. Consent Acknowledgment

Before your first telehealth session, you must sign a Telehealth Consent Form that:

  • Confirms you understand the risks and limitations
  • Authorizes participation in electronic sessions
  • Confirms understanding of emergency protocols

 

You may withdraw consent at any time, but doing so may terminate telehealth services.
